This brief report compares how various states handle the issue of jury trials in abuse, neglect, and dependency cases. Eleven states have case law that permits or requires a jury trial in these cases. The other 40 jurisdictions ‘have case law or statutes or local court rules or common practice that specifically prohibits a jury trial in abuse, neglect, dependency cases’.
