This brief report compares how various states handle the issue of jury trials in the termination of parental rights cases. Six states have statutes or case law that permit or require a jury trial in these cases, while the other 45 jurisdictions ‘have case law or statutes or local court rules or common practice that specifically prohibits a jury trial in termination of parental rights cases’.
