This article analyzes the split among U.S. appellate courts over-application of the U.S. Supreme Court’s Apprendi decision (the fact of a prior conviction may increase a criminal penalty beyond the statutory maximum for that crime, without being submitted to a jury) in the case of a prior nonjury juvenile adjudication.
